Third Party Service Providers

Payouts uses certain sub-processors, third party payment service providers and supporting financial providers, all to assist it in providing the services as described in the Terms of Service and/or the applicable Order Form.

Payouts is a processor of personal data submitted by Customers, or in certain cases, an independent controller (for example when it comes to transaction information, KYC, etc.). Payouts turns delegate some aspects of processing to another processor, or independent controller, a third party: this is termed a sub-processor or sub-processor or (as defined in the Terms of Service) a PSP or Third Party Service Providers which provide the financial services or supporting services.

Payouts engages different types of subcontractors to perform various functions as explained in the table below. Third party technical providers, which do not process data not do they provide a specific feature are not listed here (for example, third party source code, API, or other technical licenses or code).

To clarify, the table below lists three categories of sub-contractors:

    1. 1) Payment Service Provider (“PSP”) which provides the financial services, such as Airwallex listed below.
    2. 2) Third Party Service Providers which provide supporting financial services, for example, Abound that provides W8 forms and Avalara tool which provides tax calculation, both listed below.
    3. 3) Sub-contractor or sub-processor which is not a PSP or a Third Party Service Provider, which enables certain features in the platform such as Workato that does API data calls, or AWS that hosts the data, and Intercom for ticketing and support, etc.
    4. A sub-contractor is engaged by Payouts which has or potentially will have access to such personal data, therefore, there are also governed by the Payouts Data Processing Agreement, as detailed therein.
    5. Payouts undertakes to use a commercially reasonable selection process by which it evaluates the security, privacy and confidentiality practices of proposed subcontractors as well as financial licenses if applicable. Payouts has executed applicable agreements with each of the third parties listed below, however, in certain cases, the Customer will separately be required to agree and be bound by such providers’ terms, as detailed below.
